Cindy, you certainly have serious problems, and should get an attorney. Sometimes a combination of a hand impairment, particularly a one involving both hands, in combination with a leg impairment that keeps you from standing, can disable unless you have good skills, experience, or education. But that does not mean that you will or will not win your case, of course.

My aunt was declared totally disabled for having Carpal Tunnel in both hands. She was diagnosed in 1990 and was declared in 1998. She is 42years old with 2 children a 11 year old and a 15 year old. Can she work even though she is receiving a disability check?? If so what is the max. or min. that she could make? Also, when and how does she go about filing for the Insurance that is offered by disability?

Q. Can she work even though she is receiving a disability check??

A. The short answer is "maybe," but the long answer is very complicated. Please click here Q.about Working While Disabled and Drawing Benefits, for some partial answers.

Q. If so what is the max. or min. that she could make?

A. There are some partial answers at the above link.

Q. Also, when and how does she go about filing for the Insurance that is offered by disability?

A. If you mean health insurance, she should now have Medicare part A, hospital benefits, since it has been more than 2 years from the month for which she drew her first check. That card should have come automatically. And she can buy part B by asking at the local Social Security office. If she is drawing SSI, she should have Medicaid already. If she is drawing a small amount of Social Security disability, she might have a low enough income to qualify for Medicaid even though she does not get SSI; to get that she should apply at her local state Department of Social Services.

I am 35 years old and have various problems-carpal tunnel in both hands-surgury pending, 2 herniated discs -1 in my neck, and 1 in my lower back-neurosurgeon appt pending, fibromyalgia, CFS,chronic migraines, i have worked up until about 3 months ago and my neurologist suggested i take time off to see if it bettered or worsened my condition, the carpal tunnel is the only partial improvement, everything else is the same and beginning to worsen. would i qualify for any type of disability?

Possibly. You should sit down right now and talk to an attorney who handles disability cases, and possibly file a claim. If you cannot stand long or use your hands for typing, writing, or benchwork assembly, for example, you well might be disabled.

You might be able to do sedentary work fine once your hands heal. You might want to apply now so that you will be closer to the hearing if it turns out that the carpal tunnel surgery does not solve your problems.

If you cannot make it through 8 hours, you cannot work. If you cannot stand long to work and cannot perform fine or gross manipulation, you cannot work. Of course you have to prove it.

File, and if you are denied, hire an attorney. Take care and good luck.
