PLEASE ANSWER.. i WANT TO APPLY FOR DISABILITY AND I HAVE A VERY IMPORTANY QUESTION. MY DIAGNOSE IS PTSD, OCD, ANIEXTY AGORPHOBIA, ALL THAT GOOD STUFF.. WELL I HAVE A SONY .. CAN THEY TAKE AWAY YOU CHILDERN FOR THESE REASONS ..HAVE YPU EVER HEARD OF CHILDERN GETTING TAKEN AWAY FROM THEIR PARENT DUE TO A MENTAL DISABILITY

Can a child be taken away from a parent because the parent has a mental disability?

That is a family law question, and the exact answer varies from state to state. You should not take any important step in your life based solely on what you read on any website, including this one; ask a family court lawyer in your state for the answer that applies to you.

But a moment's thought will show that there are some mental problems that will disable someone, but not at all affect her ability to care for a child, and others that might affect her ability to care for a child, whether they disable her or not.

If in your Social Security case you thoroughly prove a mental condition that establishes that you cannot care for a child, or a condition that someone can make it appear does so, that could affect the outcome of a custody claim.

my fiance' draws disabled ss. he has two young girls that he has always paid child support on until he was injured at work. He drawed workers' compensation and child support was paid out of that every week of $200.00 or more dollars. when he was cut off wc he did not call child support to notify them. he signed up on ssd during this time and won with a condition called rsd. now they say he owes $12,000.00 back child support. We told them that he didn't draw any money for months and months and that it should be refigured. they have him paying over 200.00 per week for two children that does not even have his last name. they arrested him and everything. I need some advise please. how can they make him pay over 200.00 per week when he was not working all that time? can they do that? please give me some advise.

I know a lot about Social Security law, but not much about family law, and this is a family law question. I don't want to mislead you with a guess; you must talk to a local family lawyer.

Reply by Paul The person who has practical custody of a child can go down to the local Social Security office and ask to be made representative payee for the check. Maybe try this. You can also demand an accounting of the representative payee, who is presumably the birth mother. She can get in a lot of trouble.

I have children by a man who draws disability, he has nothing to do with the children so I am wondering if i terminate his rights as a parent will their disability payments stop?
