My mother is 70, a widow and has been leaving with me since 1986 She is not a US citizen but just a Green card holder. She has never worked in the US, and I am the only source of her income and housing. I am applying for her US citizenship now.
We have never applied for SSI bebefits
My father or she have never worked in the USA?

Can she receive SSI benfits? now or after she becomes a US citizen, or is she entitled to any?

In terms of residence and nationality, there are the following catagories of eligibility for SSI:

(b) You are a resident of the United States (§ 416.1603), and--
(1) A citizen or a national of the United States (§ 416.1610);
(2) An alien lawfully admitted for permanent residence in the United States (§ 416.1615);
(3) An alien permanently residing in the United States under color of law (§ 416.1618); or
(4) A child of armed forces personnel living overseas as described in § 416.216.

\TITLE 20--EMPLOYEES' BENEFITS\CHAPTER III--SOCIAL SECURITY ADMINISTRATION\PART 416--SUPPLEMENTAL SECURITY INCOME FOR THE AGED, BLIND, AND DISABLED\SUBPART B--ELIGIBILITY\GENERAL\§ 416.202 Who may get SSI benefits. [20 CFR SEC 416.202]\Current through August 7, 2001; 66 FR 41430\

Dear Mr McChesney:
Thank you for your answer which is at the bottom.

I took your answer with me to the local SSA office in Greenville South Carolina and they told me that this information was wrong. They stated that my mother needs to be US citizen.

I am lost at this point. The person was not friendly there and maybe this was a problem.

Can you help clarify, since based on your answers, she would qualify based on 416.1615, being a legal resident at this point.

Thanks

Your answer you had submitted to my original question on 5/29 at 2:38pm

Greenville! I am sitting typing in my Greenville office right now. Call me up and set an appointment and I'll either get it straightened out or learn some new law. This is a complex area. 235 2350.

"Deaf" generally equals "disabled" if the person is not actually working. But that is not all she must show. If she is an American citizen, and you lived in the United States, probably; if not, probably not. For the full and complicated details, please click here to see the Administration's page on this subject.

This is a complex question that is beyond my complete knowledge. I know that she can get Medicare only if she can somehow get Social Security disablity or retirement. She could do this if she retired on her husband's record or drew disability on his record if he was deceased and over 60, or over 50 and disabled.

There are many ways to get Medicaid, and I do not know all of them. You can study the different ways to get Medicad at The Administration's webpage on Medicaid.

I cannot answer that question. It depends on how much they have worked in the US and several other factors. Maybe sit down with a local attorney. Take care.

looking for help for florida. can you guide me.
parents immigrated on a green card dec 2005.
They are too old to work. My uncle sponsored them and took an undertaking that they will not apply for any benefits or soemthing. (the usual when sponsoring someone). What benefits can they apply for as far as SS benefits or even medical goes.
If possible can u tell me if i'm eligible to any tax refunds since they are living with me for past 6 months.
thanks for your time and this great service.
