I filed for SSDI in Feb 03, and finally was approved Feb 06, for the whole past 3 years minus that 5 month waiting period...before I knew I won my case, I tried to work and did work for two weeks. After that, I found out I won...did I screw it all up by trying to work? Does my trial work period start in Feb 03 when I was disabled or does it start Feb 2006 when I won? |

Anonymous, recent decisions establish that you are not protected by the trial work period rules for work you did before you got the letter saying you won. But most all attempts that last less than 3 months are counted as "unsuccessful work attempts" and ignored. Don't worry about 2 weeks. |

I am a 54 year old female that has been diagnosed with severe COPD. I am having a great deal of problems at work including frequent absences due to my illness. Pulmonary tests show severe air flow obstruction, severe ventilatory defect, and diffusion capacity is severely reduced.FEV1/FVC at 43% for 5' female. I also have tremors that I take medication for to keep under control. The medication (inhalers) for my COPD only make the tremors worse. I have been told my pulmonary tests automatically qualify for disability. However, I have also been told I would not receive it because my job is sedentary. I do bookkeeping and computer work. Some days I can't even manage getting dressed and to my car much less working. Do you feel I would have a chance at SSD. I have worked continuously for 36 years. Thanks for your help. |

Certainly you have a chance. If sedentary work is otherwise a possibility for you, the key is to show that you cannot attend sedentary work without having to miss an excessive number of days during the month or hours during the day. |

I live in North Carolina. My son has ADHD. I was wondering can i get benfits for him to help pay for his meds and doc bills. I am a single parent. And this is becoming alot for me to handle and hold down a job at the same time. |

I am 49yr old female I finished 8th grade and after my husband passed i got a ged ihad no skills but was able to work as a cook .I was in a car accident a semi run me off the e-way into a cement wall.I have 7 pertruding disks 4 in my neck and 3 in lower back also found sponiolsis and degenetive disk desease. the pain is great and nothing takes it away. My Dr. told me to file for s.s I have been told that thier are too many disk affected in my c spine for surgery the dr said he could cause more harm than good.tingling in fingers numb in hands feet legs back of my head. I am unable to sit or stand or lift and hardly able to take a shower or get dressed without help. I was turned down 1 time by s.s |

I have recently quit my job and have worked full time since I was 16 with Exstensive Club Feet and I'm now 30. I have always been in pain but it seems to be effecting my back and legs more now. I was told along time ago to quit work but I was going to work as long as possible. Could it be possible for me to get my benefits and how long do I need to be out of work before I can apply? I have two kids and can not afford to be without income for a long period of time. |

35 yr old male here, 8 months ago back "popped" after bending forward and could not mover at all for days, chiro doc took x-ray treated but was still bad then had me sent for MRI comes back with basically adv degenative disc disease, annular tear somewhere, and large prominent bulging disc around the C5, C4 areas, I get numbness down left left, buring in right side of lower back, can't sit for long or stand for long and barely get comfortable enough to sleep. , seen family doc and he says its bad too and is referring me to neuro doc, This has happened twice now in 7 months. I have worked before as bank mgr and have enough credits for SSDI as of now, question: should I apply for SSDI to protect myself even though more than likely I will get turned down before I am no longer qualify for SSDI? What are my chances of winning this even with a lawyer? Want to work again but not sure what I would even be able to do. Thanks |

I have already been approved for SSDI. The company in which I worked for has a retirement policy. This policy is a "defined benefit". My question is, since I have been defined as fully diasable under the laws and the SSDI guidelines, should I receive full retirement from work, or can they pentalize me? I have been employed with this company for 5 years. Under our retirement plan, we receive $42.00 times number of years served. $42.00 x 5= $210.00 This would be my montly income at retirement age. However, I am receiving $39.00 a month. Company stance is that I am being pentalized for early retirement. Is this legal since I was forced to retire? Should I not get full benefits? Thanks! |

LTD and VA offset?Was approved for SS disability and have rec'd 2 cks so far.I live in Ohio. I was on STD from Aug to Feb and applied for SS dis in Nov. I have heart disease,COPD,severe sleep apnea, osteoarthritis in hands,spine,hips and feet, Bilateral knee replacements in Nov. Diagnosed with Diabetes II in Nov. Since my LTD was thru Contract at work, I know LTD payments When apprv'd will be reduced by my SS amount. The contract says that all State, WC and SS payments are offsets. I am wondering about VA disability benefits.When I went on STD dis back in Aug I had not been diagnosed with Diabetes II. I served in VietNam during the 60's and was exposed to Agent Orange which the VA has recognized as a cause of my later year developing DiabetesII. There is now a claim pending with the VA which will provide me with a small amount mnthly. If approved will my LTD also be offset by the VA check? I read the LTD policy agreement and VA disability is not discussed. |

I am a divorced mother of a severely disabled kid born with spina bifida. He is paralyzed, wheelchair bound, and is profoundly and permanently disabled. my son draws ssi based on his fathers credits. I have not been able to work for the last 14 years because he needed constant nursing and care. I havent been able to get many work credits of my own. caring for a heavy disabled kid kills a back. I have developed severe back trouble, which is getting worse from the constant lifting and straining. I have slipped several disks, have sacro iliac joint dysfunction, and constant nerve pain shooting down my legs. I am scared. My son and I have lived solely on his SSI check for his whole life. But now my back is so bad, I am afraid I cant take care of him much longer and might have to put him in a home or something, but then I will have nothing to live on. I live on his check! I expect my bad back will make it very hard to work. would disability be an option for me? |

1. Age: 33 2. Associate Degree 3. The work I have done: 4 Years Army Mechanic, Factory Shipping, Retail stockroom,counter sales, Cylinder Filler comercial & medical gases 4. What your diagnoses are; that is, what problems the doctor says you have: I have had a laminectomy for herniated disk in my lower back, I have had a bone removed from my left ankle and had the ligaments tightend. I still have problems with the ankle, have been told RSD, arthritis, and at the begining of osteoporosis. Now have had to have disk fusion with a cage in my neck. All of this within last 3 years. Currently on short term disabillity. 5. What limitations you have because of your problems: I have problems standing, walking, using both hands and arms, bending, lifting. i fell 50 feet out of the top of a tree and broke both wrist and a hair line fracture thourgh my neck and 3 cracked ribs in my back and my doctor said that it will probably 6 months before i can go back to work i'm 29 and i've been doing tree work for 11 years he said he don't no if i'll be able to climb again and ssa told me that they don't have short term disability that you have to be disable for a year are have been disable for a year is that true and do i qualafie for disability since i don't no if i can climb trees again |

I have emailed you several times for some direction, however I have never heard back from you. I am writing for some direction on behalf of my sister. Unfortunately because I live in CA it is difficult to get more involved to help her. Tracey has been denied benefits from the SC disability no less than 6 times. Her recent denial, yesterday, came as a big blow to Tracey because she felt like she had played the "game" with the State and done all they had asked. Tracey has been found to be permanently disabled by a SC Dr and has a permanent DMV tag. Tracey has not been able to work for over 5 years and has had many surgeries to help her Fibromyalgia. To make matters worse Tracey is an epileptic and has suffered several seizures in the past month. Before I begin my all out fight against the SC disability system I wanted some advise or assistance to help my sister. |

What limitations you have because of your problems: Cannot walk, stand, crouch, climb stairs for any extended time; causes shortness of breath and fatigue. Stooping (bending over) causes coughing episodes. Cannot concentrate for extended periods of time due to coughing and dyspnea...makes it almost impossible to perform critical troubleshooting. I am a 60 yr. old male, high school grad, worked as a casino dealer for the past 16 years. I have been diagnosed with diabetes melitus, take insulin up to 4 times a day, have neuropathy in both legs, have hypertension, degenteritive back problems, and have had a heart attack, with three stints inserted, also have sleep apnea...what are my chances of getting Social Security disability? I am not able to peform my old job, as I can't stand on my feet for long periods of time..Biloxi, MS. |
