I am on ssi i scored above 69 that got me down as mental retardation how can i get out of my moms house i dont think i'm not stupid i am smart i wounder how can i get out of my moms care?

Reply by Paul The question of who decides where you live is not a Social Security question.

The question of who gets your check is. If you can get a doctor to say you can handle your own affairs, you might be able to get the check coming in your own name. Or, you might be able to get someone else to be your representative payee. Start by having that person take you to your local office and explaining why your mother isn't doing a good job. You will have to convince them that she isn't.

I think I have this right: For Social Security Disability and retirement, you get the December check, for instance, on January 3d. If the beneficaiary dies on December 15th, that check is due back. I am not quite sure this is how it works, however. Take care.

I was found disabled and awarded SSI,
But the worker at the Social Security
office said , I will get half the money that is owed to me now, and the other half, in 6 months.
I have never heard such a thing.
Is that legal in The state of North carolina

Federal law, the laws passed by the US Congress, control over any state law.

SSI is a Federal law.

It says that there is a limit to the amount of SSI back time the Social Security Administration can pay out at one time.

The limit is in 2003 a little over $6,000. It goes up every year.

If your back time check is for more than that, it will be paid in 6 month installments until it is all paid to you.

Children's back time checks are treated a little differently.

I dont have a bank account and cannot get one because of overdrafts in an old account. Will i still receive my sons ssi backpay for 14 months. if not what will happen. i am in chex sysem for 7 years

If you tell told the Administration from the start that you did not have a bank account, they should send the checks directly to you, and you should have no problem.

If you ever gave them an account and then had it closed, when the big check or your monthly checks are supposed to come, you could have a big problem:

In that case the Administration often just starts sending the checks to the closed or forgotten bank account. The bank sends the checks back, but the Administration can't seem to realize that they have them, and so won't re-issue them to you. That is a big problem, that could delay payment of a lump sum by many months.

If you have told the Administration about a bank account that you must close, tell them right away and be positive that you get your record at the Adminstration corrected! And try to keep the bank account open with a few dollars in it anyway, in case they forget!

Mike, if a person has a concurrent SSI and Social Security disability claim, and wins both, more often than not she gets a lump sum SSI check, followed by monthly Social Security disability, and then a lump sum Social Security disability several months later.

If it is SSI, you must go down to the local office and update your income and resources. You should do this within about 2-3 weeks of when you get your favorable decision from the judge.

If they give you a list of things to go get, get them or you will never get anything.

Once you do that, around here it takes around a month and a half to get benefits. It takes more or less time in other parts of the country.

If you don't get anything in a month or so, go down to the local office and find out why.

SSD, or Social Security disability, is a little different.

at my last hearing, the judge and my attorny agreed on the back pay all the way from july 2003,however when i spoke to rep. from s.s.a. he states that the funds would be paid back to dec. 2003??also i won s.s.i benifits only not as many monthes, i'm not sure what i said to him but now i don't have madicare/medicade,? due to the ergency to get my bakpay. was this the phone call i was NOT to have as my attorney said?

I am not sure what your questions are. Let me say what I think you meant and answer those questions; if I have misunderstood let me know.

Q. I proved disability back to July of 2003. Why is my first check for December of 2003?

A. In Social Security disability there is a 5 month waiting period between the time you become disabled and the time you can draw your first check.

I do not understand the rest of your questions. Ask your attorney; he can probably answer better than I can, anyway. Take care.

My question is: I received a fully favorable decision from the Administrative Law Judge, i received the first installment of back pay and i received my first monthly payment from SSI, my question is How long does it take for my SSDI to take effect, which should be a larger monthly amount since i did work and i had my credits in, also they say i cannot sign my kids up for dependent benefits until i start receiving SSDI, is this correct?

Well, you can go ahead and go down to the local office and ask for benefits for your kids right now.

Usually you should get your first Social Security check, if you are entitled to a Social Security check, about the time you get your lump sum SSI check. In 2005, it is taking about 3 months from when you get your lump sum SSI check before you get your back Social Security check. If it takes longer than that, you need to do something.

Sir: I am in a dilemma,I was awarded ssdi benefits by the judge signed November,7.2005.On nov 22 I was told to go down to the ssa office to talk about seeing if I am eligible for ssi.I was not feeling all that well and I believe I misled the rep on the fact that I lost my home due to my ill health.I made him think my home was foreclosed on,but the fact is the home WAS in foreclosure but i was able to sell the home two weeks before the home was officially declared foreclosed.I hope he didnt think i was lying to him,I signed an affidavit that said the home was foreclosed,but it was not technically.did I screw up my ssdi benefits or perhaps just the ssi,which I didnt think i was supposed to get anyway because i had income this year.only about 2000.00 total.I did receive 6100.00 at closing when home was sold but I paid off bills and my car and there is nothing left.the money was all spent in 2004.please help.

Dear Paul,
After going through three years of various appeals, the ALJ's unfavorable decision was overturned and I became approved for SSDI beginning June of '04. On a letter from SS dated (stamped) September 26, 2005, it stated the monthly amount and that it would begin for January 2005 and it did point out that this would be for December. They also informed me of the exact amount of my back check which began in December of '04, not June because of that holding period. My question is this: I called the SSA. They said that my check, the one for thousands of dollars, was in the processing center in Baltimore, MD. Do you have any experience on when I can actually expect to receive that check? I have received different answers from SSA depending on who one might talk to at any given day. I've heard 4 to 6 weeks, then one more, then another, but still I have no idea of how much money I need to keep borrowing from my brother to survive. It's a very uncomfortable situation. Any information would be so very appreciated. I would also like to tell you that I read much of your forum and I for one appreciate the service that you do here!

SSI is handled by your local office. I guess you could camp out there and talk to the person who is developing your case.

Joe, I hope you have your check by now. There are three situations:

SSI only: After you get your favorable decision, go down to the local office and give them everything they ask for. In my area, in 2006, it is then taking about 2 months after you give them the last thing they ask for.

Social Security disability only: About two months after you get your notice, you get a lump sum and monthly benefits.

Concurrent claims, that is, SSI and Social Security disability: The SSI part works as above, and the monthly Social Security disablity check comes in about 2 months, too. But the lump sum Social Security disability comes about 3 months after the lump sum SSI check. Why? Because the local office has to send the SSI file to Baltimore where the Social Security disability check is calculated.

I received a favorable disision on March 31 2006. I have already talked to the lady at ss she said she was going to approve my benifits. Now it has went to Baltimore and they received it on the 10th of April. When should i expect a check?

They said they would get me started then worry about my kids. Do the kids get a check or do they add it to mine. They said i was getting $601 a month, is that including the kids, or not. Thank You I also have an attorney, and they said it was a good thing that ss was approving my claim, and the fact that someone picked up my case right away was good.And they said that means i will get a check sooner. But they will not tell me how soon or even guess.I have three kids to feed, and a husband who is working hisself crazy trying to keep us afloat.

I recieved a letter stating that i was eligable to recieve benefits that had something to do with my father, which the social security said i was entitled to up to my eighteenth birthday, so I gave them every thing they ask for but i am still wondering what its about and if it will be a monthly check or a lump sum payment since i am now 28.

i am going to receive about 603$ a month and I have a 3 year old. i am very upset because my mother with whom I do NOT get along with and lives several states away is going to be my representative payee!!! she has not received a check yet.
she is already giving me problems about the money! I am currently homeless ( i lost my last place because i could not afford it because i had no income) and i have no car and she is not willing to give me money to get a place or fix my car!!
I am curently living with a friend's mother that I have known for 3 years and am thinking of changing her as a rep. payee but I really need to get a place to live ASAP for myself and my daughter and need the backpay money to do so:
so my question is this, how long to get a decision on your rep payee being changed or not (after you fill out all the paperwork) and also how long after that til the check arrives?

Yes I was just awarded SSI benefits from July 2004 and was told that I had to get my money in installments. A friend of mine who is not an attorney and is not set up for direct pay is owed a total of $ 6, 300.00 This includes my SSD claim and money paid from his pocket over the years. Since they are paying me in installments and cannot pay him directly, I Should be able to request they at least pay me his fee so I can pay him. I want him to have his money as he did a wonderful job for me, and again we are friends. This new installment thing only pays up to 3 months at a time. He should not have to wait for his money. Please advise.

My husband was recently found to be disabled by an ssi judge the said they said he was found to be disabled as of sept 2003 his backpay is alittle over 12,000 dollars at first they said he would get a payment every 3 months now they say he will get a payment this month then another one in december and the final payment in june of next year this just doesn't seem right is there any thing we can do. Also we just found out yesterday that he has lost his hearing in his left ear and there is nothing they can do about it. Will this make a difference do we need to inform them. We have a child does my husbands benefits include financial care for our son.

I have Tourettes syndrome and I am 18 i used to be on ssi when i was younger but I want to know if i can get back on ssi. What do i have to do or have to qualify for it. Like do i have to be on medication or what. I was told that sence i was on it before when i was younger and cause i have tourettes and need financial help with every day expences mainly school costs car gas place to live ect i should be able to get it. is that true

I applied for SSDI on Sept 21 and the Disability Claims Adjudicator called today (Nov 4) and told me that she was going to rule favorably in my case. This seems rather fast. I am quite relieved. I spoke with you several months ago and you were very reassuring and I want to thank you for that. I have lumbar stenosis (and sciatic pain), severe cervical degenerative changes, significant OA in both knees, I'm 58, quite overweight, regular insomnia and depression as the result of an "aware anesthesia" experience and 25 surgeries in the last 18 years. I have survived oral cancer four times (the first in 1987). There is more but nuff said. The job I held until last December was 8 hrs on my feet. I tried to go back to work after knee surgery last winter but could not stand more than 2 hrs. All of my doctors were very supportive. Do you think that their support, my age, weight and medical conditions were the major factors in such a quick determination? Or was I just plain lucky? The determination would probably have been even sooner but I didn't get the final paperwork turned in until this past Tuesday. Thanks for all the great work you do here, Paul. I wonder how soon before I see a check. I haven't worked since December of last year. Money is in short supply. Still waiting for word on LTD. I applied for that back in August.

PS.....Listen, folks, don't give up hope...and don't think that one of the horror stories will happen to you. Think positive and do your homework. Listen to Paul. His advise is top notch.

In my area, it takes about 2 to 2 1/2 months. It might be more or less in other areas.

They start SSI benefits the later of the day you applied or the day the judge says you became disabled.

They start your Social Security Disability the earlier of one year before the day you applied or 5 months after the day the judge says you become disabled, whichever is later.
